1. Acceptance of Terms

By registering and using the Exam Creator (“the Platform”), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use the Platform.

2. Eligibility

The Platform is intended for users who are at least 18 years of age. By creating an account you confirm that you meet this age requirement. We reserve the right to verify your details and to suspend accounts that do not meet this eligibility criteria.

3. Account Registration

You must provide accurate and complete information when registering, including a valid 10-digit mobile number. You are responsible for maintaining the confidentiality of your username and password and for all activity that occurs under your account.

4. Use of the Platform

You agree not to misuse the Platform, including but not limited to: attempting to access the account of another user, copying or redistributing content for commercial purposes without permission, uploading malicious software, or interfering with the proper working of the Platform.

5. Content Provided by Users (Teachers)

Teachers who contribute questions confirm that they have the right to share such content and that it does not infringe on the rights of any third party. The Platform may review, edit, or remove user-contributed content at any time.

6. Question Relevance Policy

Teachers must ensure that all questions created or uploaded are strictly relevant to the selected subject, topic, and syllabus. Creating misleading, irrelevant, inappropriate, or intentionally unrelated questions is strictly prohibited.

Violation of this policy may result in question removal, suspension, or permanent banning of the teacher’s profile without prior notice. By creating or uploading questions, you agree to comply with this policy and maintain the quality, accuracy, and relevance of all educational content.

7. Privacy

We collect the information you provide at registration (name, email, mobile number) and while completing your profile (photo, gender, date of birth, affiliated organization, qualification, and stream) to operate and improve the Platform. We do not sell your personal data to third parties.

8. Limitation of Liability

The Platform is provided on an “as is” and “as available” basis. We do not guarantee that test results reflect real-world outcomes. To the fullest extent permitted by law, the Platform shall not be liable for any indirect or consequential loss arising from your use of the Platform.

9. Termination

We may suspend or terminate your account if you violate these Terms & Conditions or if your conduct is harmful to other users. You may stop using the Platform at any time.

10. Changes to These Terms

We may update these Terms & Conditions from time to time. Continued use of the Platform after changes are published constitutes acceptance of the revised terms.

11. Performance-Based Refund Policy

The full cancellation & refund conditions are set out in our Cancellation & Refund Policy. The key conditions are reproduced below for convenience.

Our Performance-Based Refund Policy is designed to reward students who demonstrate exceptional consistency and preparation but nevertheless do not clear the applicable examination cutoff.

A student may become eligible for a refund only when all of the following conditions are satisfied:

1. The student must purchase the complete/full test package for the relevant subject and examination directly through our platform.
2. The student must complete all tests included in the purchased package at least 50 times each. Merely opening, starting, or partially attempting a test will not be considered a completed attempt.
3. The student must maintain an average score of more than 95% across the qualifying test attempts, as calculated by our platform.
4. The student must appear for the relevant official examination for which the purchased test package was intended.
5. The student must provide valid proof of their official examination result/scorecard when requested by the platform.
6. The student must not qualify for / must not clear the applicable official cutoff for the relevant examination, subject, category, or post, as applicable.
7. Eligibility will be determined using the examination's officially published cutoff/result information and the student's verified performance data available on our platform.
8. The refund will be applicable only to the eligible purchase amount. The following amounts will not be refunded:
   • GST or other applicable government taxes;
   • Platform/payment processing charges;
   • Any discount, coupon, promotional benefit, cashback, or other concession provided at the time of purchase;
   • Any other non-refundable charges expressly identified at the time of purchase.
9. A 2% deduction will additionally be made from the eligible refundable amount towards refund/transaction processing and associated administrative costs.
10. The refund will be processed only to the same account/payment method from which the original purchase was made, subject to the payment provider's rules. Refunds to a different bank account, UPI ID, wallet, card, or third-party account will not be permitted.
11. The student must submit a refund claim within the period specified by the platform after publication of the relevant official examination result/cutoff.
12. The platform may verify the student's test-attempt history, scores, account information, examination details, and submitted documents before approving a refund.
13. Attempts, scores, accounts, or other activity that appear to involve manipulation, fraudulent activity, automated activity, multiple accounts, sharing of accounts, or circumvention of platform rules may be excluded from eligibility.
14. Only genuine attempts recorded under the student's verified platform account will be considered.
15. The refund policy applies only to eligible purchases made after the policy becomes effective and may not be applied retrospectively to purchases made before that date.
16. The platform reserves the right to verify eligibility and reject a refund claim if any of the above conditions are not satisfied.
17. There is no refund in case of a user banned from our platform.
18. This refund policy is a performance-based promotional offer and does not constitute a guarantee of examination success, selection, rank, employment, or qualification.
19. The final determination of refund eligibility will be made based on the platform's recorded data, applicable examination rules, and the official examination result/cutoff information.

12. Intellectual Property and Prohibition of Unauthorized Extraction

All content, including but not limited to mock test questions and exam materials provided on the Exam Creator platform, is the exclusive intellectual property of Impector Technologies Pvt. Ltd. Users are strictly prohibited from attempting to copy, record, reproduce, distribute, or share any exam questions or platform content by any means.

This strict prohibition includes, but is not limited to, the use of screen recording software, external cameras or recording mediums, data scraping or extraction tools, screenshots, screen capturing, or any other manual, digital, or automated methods.

Any unauthorized extraction, sharing, or distribution of platform content constitutes a severe breach of these Terms and Conditions. In the event of such a violation, Impector Technologies Pvt. Ltd. reserves the right to immediately terminate the user's account without notice or refund, and will initiate strict civil and criminal legal action. Any disputes, legal proceedings, or claims arising out of such violations shall be subject to the exclusive jurisdiction of the competent courts located in Purulia, West Bengal, India.

13. Copyright and Intellectual Property Rights

All materials, software architecture, user interfaces, designs, text, graphics, logos, and database content—including but not limited to the mock tests and question banks hosted on the Exam Creator platform—are the exclusive intellectual property of Impector Technologies Pvt. Ltd. This content is protected under the Indian Copyright Act, 1957, and other applicable domestic and international intellectual property laws.

The compilation, organization, and display of all content on the Exam Creator platform are the exclusive property of Impector Technologies Pvt. Ltd. Users are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the platform solely for its intended educational and assessment purposes.

You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, or in any way exploit any of the platform's content, software, or services, in whole or in part, without prior written, express consent from Impector Technologies Pvt. Ltd.

Impector Technologies Pvt. Ltd. actively enforces its intellectual property rights to the fullest extent of the law. Any infringement of these copyrights, including the unauthorized extraction or republication of our proprietary mock test data, will result in the immediate termination of your account and will be met with strict civil and criminal legal action. All legal proceedings regarding copyright infringement claims shall be subject to the exclusive jurisdiction of the competent courts located in Purulia, West Bengal, India.

14. Misuse of Platform, Account Termination, and Forfeiture

The Exam Creator platform is designed strictly for legitimate educational and assessment purposes. Users are required to maintain accurate profiles and utilize the platform's features responsibly. You are strictly prohibited from engaging in any form of platform misuse, which includes, but is not limited to:

1. Content Spamming: Adding, generating, or uploading irrelevant, spam, or unnecessary questions and mock tests.
2. Improper Uploads: Uploading unnecessary, inappropriate, or unauthorized documents and files to the platform.
3. Identity Misrepresentation: Utilizing fake, duplicate, offensive, or impersonated profile pictures.
4. Falsification of Information: Providing false, inaccurate, or misleading personal information, including fake mobile numbers, incorrect contact addresses, or invalid email addresses during registration or account updates.

Consequences of Misuse:
Impector Technologies Pvt. Ltd. reserves the right to actively monitor accounts for compliance. If you are found to be engaging in any of the aforementioned prohibited activities, Impector Technologies Pvt. Ltd. will take immediate action to permanently ban and terminate your profile without prior notice.

No Refund Policy for Terminated Accounts:
In the event of an account suspension or ban due to platform misuse, your access to the Exam Creator platform will be immediately revoked. You will permanently lose access to all platform features, including any previously purchased mock tests, subscriptions, or digital services. Under these circumstances, absolutely no refunds—partial or full—will be issued for any prior purchases.
